We are Downshyft. Formally, we are Downshyft Inc. ("Downshyft," "Motossembly," "we," "us" and "our").

Among other things, we are a virtual gathering space for everyone who loves motorcycles. We provide our services online, including via the Motossembly app and the Motossembly website (collectively, the "Services").

This Privacy Statement explains how we and some of the companies we work with collect, use, share and protect the information you provide to us. It also discusses your choices about the collection, storage and use of your Personal Data.

1. Information We Collect

We collect Content from you while providing the Services. Some is Personal Data necessary to provide the Services, while other Content includes Behavioral Data and Non-Personal Data that we aggregate to improve our Services.

  • Profile information: Your name, address and other profile information you choose to share.
  • Location Information: Your postal address or geographic location, including GPS data embedded in or accompanying your content.
  • Communications: Emails, SMS, text messages, and other electronic communications sent between you and Downshyft.

Information we gather from your use of our Services

  • Analytics: We use third-party analytics tools (including Google Analytics) to measure traffic and usage trends. You can opt out of Google Analytics here.
  • Metadata: Technical data associated with your content, such as when and how it was collected.
  • Log Data: Information automatically recorded by our servers including IP address, browser type, operating system, referring web page, pages visited, and cookie information.

2. How We Store Your Information

We currently provide the Services from within the United States, and we store all User Content, including Personal Data, on servers inside the United States.

By using our Services, you consent to the collection, storage, processing and onward transfer of your personal information as stated in this Privacy Statement and our Terms of Service.

3. How We Use Your Information

  • With Your Consent: We may ask permission to share your Personal Data with other organizations to provide Services.
  • Partners and Affiliates: We may share your Personal Data with Partners to sell and provide the Services.
  • Cookies: We use cookies to recognize your device, provide features, and remember your preferences. You can manage cookie settings in your browser.
  • Do Not Track: We make reasonable efforts to honor "do not track" settings on users' devices.

  • Remember information so you don't have to re-enter it
  • Provide personalized content and information

  • Monitor metrics such as total visitors, traffic, and demographic patterns

4. Your Right to Review, Request Changes, and Disclose Personal Data

Where required by applicable laws, each user may inspect and receive a copy of their Personal Data as stored in the Services. If you believe the Personal Data we have is incorrect or incomplete, you may request an amendment in writing.

Any information you voluntarily disclose for use of the Services may become available to the public if you release it to other users or to the general public.

5. Children

Users who are ages 16 and 17 (Minor Users) may use the Services with verifiable parental consent. Children under age 16 are not permitted to use the Services.

Downshyft will not sell, rent, or purchase any Personal Information collected from Minor Users. We will only share Minor User information with employees, contractors, subsidiaries, and service providers who need it to perform a business function for Downshyft, or as required by law.

6. Changes to this Privacy Statement

We may modify our Privacy Statement from time to time with prior written notice sent to the email address we have for you. For users who have not provided an email address, the revised Privacy Statement becomes effective ten (10) calendar days after posting on the Services.

7. Your Privacy Rights (California & Other States)

This section has been adopted to comply with the California Consumer Privacy Act of 2018 ("CCPA"), and applies to residents of other states with similar regulations.

Right to Deletion

On receipt of a verifiable request, we will delete your Personal Data from our records and direct service providers to do the same, subject to certain exceptions required by law.

Right to Opt-Out

If you are 16 years of age or older, you have the right to opt-out from the collection and sale of your Personal Data.

Protection Against Discrimination

You have the right to not be discriminated against for exercising any of your privacy rights.
